This Policy also describes our policies and practices when you use our services (“Services“). If you engage in Services offered by us, then you may be subject to other terms and conditions and disclosures relevant to the Services that are not included in this Policy.
BY ACCESSING OR BROWSING THE SITE, REGISTERING OR USING THE SERVICES AVAILABLE AT THE SITE OR THROUGH OUR APPLICATIONS, YOU CONSENT TO THE COLLECTION AND USE OF YOUR INFORMATION AS DESCRIBED IN THIS POLICY, AS MODIFIED FROM TIME TO TIME BY US.

THE TYPES OF INFORMATION WE COLLECT.
We collect several types of information on our Site depending on how you use the Site. We collect “Personal Information”, which generally speaking is information that can be used to identify you individually, such as your name, email address, phone number, and other information.
Some of the Personal Information you provide permits us to contact you online or by electronic communication. Once you agree to provide us with Personal Information, you are no longer anonymous to us. If you choose to use or purchase the Services we may require you to provide contact and identity information, billing information, and other Personal Information as indicated on the forms we provide to you. You always have the option to not provide information by choosing not to use the Site or use our Services.
We also collect information about you that does not itself identify you individually, and aggregate information, which is information about use of our Site, such as pages visited on our Site, and your activity patterns and keystrokes. 1. Registration and Transactional Data
If you register for an account using our Site or Services, you are required to submit a name, email address, password, phone number, and any additional Personal Information we may request. We may collect and store access information related to your account.
When you have an account with us, the combination of your username and your password is the key to your account with our Services. We recommend that you use a unique combination of letters, numbers, and special characters to create your password. You are responsible for all actions taken in the name of your account. You should not disclose your password to anyone. You may be subject to legally binding actions taken on your behalf. Therefore, if your password has been compromised for any reason, you should immediately notify us at support@shilo.ai and, if available, login to your account at the Site and change your password.
We may also track and retain the details of all transactions and communications between customers, registered accountholders, target audiences, and other visitors on our Site and Services such as emails, Feedback (as defined below), comments, Communications (as defined below), Transcripts (as defined below), and any other forms of communications. We may use your name and other Personal Information when you send an email or other communication through our Site or Services.
2. Payment Information
If you use our Services, we collect information related to your transaction. This information includes your email, payment method (credit card or debit card number, account, ACH, and authentication information), and billing information. This information is processed through a third-party payment processor. You should look to the third-party payment processors’ terms regarding payments and contact them directly if you have any inquiries.
Your payment for purchased Services may be charged directly by us through our third-party payment processor, Stripe, or any other third-party payment processor we may use. Please review the following link to review Stripe’s terms: https://stripe.com/payment-terms/legal. To the extent the Services or any portion thereof is made available for any fee or through a subscription, your access will be granted following payment of the applicable fees to Company. Your account and access to the Services may be suspended in the event of non-payment of applicable fees. We may, but are not obligated to, cancel inactive, or unpaid accounts or subscriptions. If your subscription or other agreement for Services is renewed, we may increase the fee for the subsequent renewal term.
You agree to provide accurate and complete billing information, including valid credit card information, your name, mailing address, and email address, and to provide Stripe or other third-party processor with any changes to such information.
3. Information from Interactive Features
Our Site may have a chatbot, chat room support, or other interactive technologies that allow individual comments and messages to be tied to an accountholder’s or visitor’s name, email address, or other Personal Information. Any information you provide or post in these interactive technologies is considered Feedback (as defined below), and we may use or incorporate such information in our Services.
4. Recordings and Transcripts; Inference Data
Our Services provide certain features and interactive technologies that allow users to record voice communications, conversations (including phone and in-person conversations), and other interactions conducted through or with the Services (collectively, “Recorded Communications“). You represent and warrant that you have provided all required notices and obtained all legally required consents from all participants included in the Recorded Communications. Recorded Communications may be processed by our artificial intelligence (“AI“), engine, automated, or human-assisted technologies (“Company Technologies“) to create a transcript of such Recorded Communications (“Recorded Transcripts“). The Company may review the Recorded Conversations for purposes of providing, operating, and supporting the Services (including providing training services). If you do not wish to record communications, you should not enable or use the recording features in the Services. By activating or using recording features, you acknowledge and agree that communications conducted using such features may be recorded, processed, stored, and otherwise handled as described in this Policy. You represent and warrant that your use of recording features complies with applicable laws and regulations, including any notice and consent requirements.
In addition, we may receive phone conversations or other interactions that have been previously recorded by or on behalf of our customers (“Previously Recorded Communications,” and together with Recorded Communications, the “Communications“)). Such Previously Recorded Communications may be transmitted to the Company by the customer, the customer’s telephone carrier, communications provider, customer relationship management technology, or other service providers. Such transmissions may occur automatically through integrations, call-routing configurations, or other technical means used in connection with the Services. Additionally, Previously Recorded Communications may be transmitted via our access to third-party systems, such as your customer relationship management (CRM) platform. The Company receives such conversations solely for purposes of providing, operating, and supporting the Services (including providing training services). Previously Recorded Communications may be processed by our AI or Company Technologies to create a transcript of such Previously Recorded Communications (“Previously Recorded Transcripts,” and together with the Recorded Transcripts, the “Transcripts“).
Communications, and related Transcripts derived from such Communications, may include Personal Information and sensitive information, such as social security numbers, driver’s license numbers, bank account and routing numbers, financial information, security information, physical location, racial or ethnic information, religious information, sexual orientation, citizenship or immigration status information, and other sensitive information (collectively, “Sensitive Information“). We take measures to redact the inclusion of Sensitive Information in the Transcripts. Any redaction of Sensitive Information is provided on a best-efforts basis and is not guaranteed to identify, detect, or remove all Sensitive Information. Users remain responsible for avoiding the submission of Sensitive Information through the Services to the extent feasible. The Company makes no representations or warranties regarding the completeness, accuracy, or effectiveness of any redaction efforts, and users remain solely responsible for the content of Communications submitted through the Services.
To the extent Communications or Transcripts include personal information collected in connection with your interaction with one of our business customers, that customer is the data controller. The Company acts as a service provider and processor with respect to such data and processes it solely on behalf of and at the direction of our customer. Requests to exercise privacy rights, including requests for access, correction, deletion, or restriction of processing of such data, should be directed to such applicable customer.
We may also use our AI and Company Technologies to analyze the Communications and Transcripts to generate summaries, insights, classifications, recommendations, predictions, or other derived or inferred data (“Inference Data“) that is derived from the Company’s platform generated analytics for the purposes of providing the Services to you, and operating, maintaining, improving, securing, and supporting the Services. Inference Data may include analytical outputs, patterns, or indicators relating to communication styles, behavioral tendencies, preferences, sentiment, or other psychological or personality-related characteristics (such as generalized personality or interaction profiles). Such psychological or personality-related indicators are generated through automated, AI-based, or statistical analysis and are intended to provide informational insights and used to provide suggestions, guidance, training, coaching, or educational insights to users or their authorized users in connection with the use of the Services. Such indicators are not intended to constitute medical, psychological, or clinical assessments. You acknowledge and agree that all right, title, and interest in and to any Inference Data are and shall remain the exclusive property of the Company.
Communications and Transcripts may be retained for as long as reasonably necessary to provide the Services and fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law or contract. We implement safeguards designed to protect Communications and Recorded Transcripts from unauthorized access, use, or disclosure. However, no system can be guaranteed to be completely secure.

5. System Data
We may collect System Data (as defined below) to help maintain, monitor, secure, support, improve, and develop the Services. “System Data” means data, information, and records generated by or through the operation of the Services or the Company Technologies, which includes technical, operational, and usage-related data. System Data includes, but is not limited to: platform logs; access logs; audit logs; event logs; error reports; performance metrics; uptime and latency data; feature usage data; configuration data; device, browser, and application metadata; timestamps; IP address–derived information; system identifiers; telemetry; security and fraud-detection data; and other metadata or operational data collected or generated in connection with the Services.
You acknowledge and agree that all right, title, and interest in and to any System Data are and shall remain the exclusive property of the Company.
6. Contact Us Information and Feedback
We may collect information that identifies you personally when you submit comments, questions, or suggestions to us, or to the Site using the Contact Us form or by email, including attached files in an email sent to us. We may also track and retain the details of all transactions and communications you have with us or other users such as emails, ratings, sale and purchase of products or services, and any other forms of communications.
Any feedback, comments, ideas, improvements, suggestions, or similar items (collectively, “Feedback“) provided by you to Company with respect to the Site or Services shall remain the sole and exclusive property of Company. Accordingly, you further agree to assign to Company, and hereby do assign to Company, all right, title, and interest in, to, under, and arising from any Feedback, including if such Feedback results in any improvements and enhancements to the Site or Services. We may use any Feedback you provide and incorporate such Feedback in our Site or Services.
7. Computer and Device Information
We collect information from or about the computers and devices that you use to access the Site, as determined and allowed by the personal settings you have for the computer and device. We collect the Internet Protocol (IP) address, domain name, browser type, operating system, device settings, location, web log files, and other code tracking devices from any device you use to access our Site and any pages at our Site. You can turn-off and adjust settings on your computers and devices that will not allow us to collect information. For example, in many cellular devices, you can turn off location settings by selecting the “Settings” feature, choosing “Privacy” and turning off “Location.”

Some content or applications, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies to collect information about you when you use our Site. The information they collect may be associated with your personal information or they may collect information, including personal information, about your online activities over time and across different websites and other online services. They may use this information to provide you with interest-based (behavioral) advertising or other targeted content.

HOW WE USE AND SHARE INFORMATION.
1. Provide our Services

We may transfer information to service providers who provide technical infrastructure services, deliver ads and other content, analyze our Services, measure the effectiveness of our ads and Services, or provide other services that may be necessary.
We may outsource all (or some) of the tasks described in this Policy to third parties and may only share your Personal Information as needed for performance of those tasks. In that case, you can still visit and browse the Site subject to the Terms of Service; however, you will not have access to or receive the benefits conferred upon registered users of our Site. If you do not wish to receive information and promotional material from us or from our affiliates, you may select the appropriate “opt-out” option or STOP request in the communication, or email us at support@shilo.ai. Please be aware that we cannot always delete records of past interactions and transactions. For example, we are required to retain records relating to previous sales and purchases for financial reporting and compliance reasons.
